1. Acceptance of Terms
By downloading, installing, or using the BrgyMart mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User") and BrgyMart ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance.
2. Description of Service
BrgyMart is a hyperlocal delivery platform that connects customers with neighborhood stores and riders within the Philippines. The App facilitates the placement of orders, coordination of delivery, and communication between customers, sellers, and delivery riders.
BrgyMart acts as a marketplace and logistics platform only. We are not the seller of any goods; individual store partners are responsible for product quality, accuracy, and fulfillment.
3. Eligibility
You must be at least 18 years old to use BrgyMart. By using the App, you represent and warrant that you meet this age requirement. Users under 18 may only use the App under supervision of a parent or legal guardian.
4. User Accounts
4.1 Registration
You may sign in using Google or Facebook OAuth, or via phone number OTP. By signing in, an account is automatically created on your behalf. You are responsible for all activity under your account.
4.2 Account Security
You agree to keep your login credentials confidential and to notify us immediately at support@brgymart.com of any unauthorized access to your account.
4.3 Accurate Information
You agree to provide accurate, current, and complete information when using the App, including your delivery address and contact details.
5. Orders and Payments
5.1 Placing Orders
When you place an order through BrgyMart, you are making an offer to purchase goods from a store partner. The order is confirmed once accepted by the store.
5.2 Pricing
Prices displayed are set by individual store partners. BrgyMart is not responsible for pricing errors. Delivery fees are calculated based on distance and are shown before order confirmation.
5.3 Payment Methods
We currently accept Cash on Delivery (COD) only. You pay the rider directly upon receipt of your order. Additional payment methods may be introduced in future updates.
5.4 Refunds and Cancellations
Orders may be cancelled before they are accepted by the store. Once preparation has begun, cancellations are subject to store policy. Refunds for valid disputes are processed within 5–7 business days through the original payment method.
6. Delivery
Delivery times are estimates only and may vary due to traffic, weather, and demand. BrgyMart is not liable for delays caused by circumstances beyond our reasonable control.
You must be available at the delivery address at the estimated delivery time. If you are unreachable, the rider may leave the order at the address at their discretion.
7. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose
- Place fraudulent or false orders
- Harass, threaten, or abuse store partners, riders, or BrgyMart staff
- Attempt to reverse-engineer, hack, or disrupt the App
- Create multiple accounts to abuse promotions or referral programs
- Use automated scripts or bots to interact with the App
Violation of these prohibitions may result in immediate account suspension or termination.
8. In-App Communications
BrgyMart provides an in-app messaging system to facilitate communication between customers, riders, and sellers. By using this feature, you acknowledge that:
- All messages sent through BrgyMart are stored on our servers and may be reviewed by authorized BrgyMart personnel for safety, dispute resolution, and fraud prevention purposes
- You must not use the messaging system to solicit transactions outside the platform, share personal financial information, send unsolicited commercial messages, or engage in harassment or threatening behavior
- BrgyMart is not liable for the content of messages sent by users, but reserves the right to take action including account suspension for misuse of the messaging feature
9. Intellectual Property
All content in the App — including but not limited to logos, icons, text, and interface design — is the property of BrgyMart or its licensors and is protected under Philippine intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
10. Limitation of Liability
To the maximum extent permitted by applicable law, BrgyMart shall not be liable for:
- Any indirect, incidental, or consequential damages arising from your use of the App
- Loss or damage to goods after delivery is confirmed
- Actions or omissions of third-party store partners or riders
- Service interruptions due to maintenance, technical failures, or force majeure
Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Philippines.

1. Who We Are
BrgyMart ("we," "us," "our") operates the BrgyMart mobile application, a hyperlocal delivery platform connecting customers, sellers, and riders in the Philippines. We are the Personal Information Controller under RA 10173.
2. Information We Collect
2.1 Information You Provide
- Account information — Full name, email address, and phone number when you register or sign in
- Delivery address — Your saved delivery addresses and location pins
- Order details — Items ordered, special instructions, and order history
- Payment method — Currently Cash on Delivery only; no card or e-wallet credentials are collected or stored
2.2 Information Collected Automatically
- Location data — GPS coordinates when using the App to enable accurate delivery
- Device information — Device model, operating system version, push notification token, and app diagnostics
- Seller device features — Bluetooth printer connection details, paired printer preferences, and receipt-print settings used in the BrgyMart Seller app
- Usage data — App interactions, screens visited, and in-app behavior for improving our service
- Crash reports — Automatic error reports via Sentry to help us fix bugs
2.3 Information from Third Parties
- Google OAuth — Name, email, and profile photo if you sign in with Google
- Facebook OAuth — Name, email, and profile photo if you sign in with Facebook
3. How We Use Your Information
We use your personal information to:
- Create and manage your BrgyMart account
- Process and fulfill your delivery orders
- Send real-time order status updates and push notifications
- Support seller-side order alerts, Bluetooth printer setup, and receipt printing preferences
- Assign the nearest available rider for your delivery
- Resolve disputes, refunds, and customer support requests
- Improve our platform through usage analytics and crash data
- Comply with legal obligations under Philippine law
We do not sell, rent, or trade your personal information to third parties for marketing purposes.
4. How We Share Your Information
4.1 Store Partners
Your name, delivery address, and order details are shared with the store partner fulfilling your order. They are contractually required to keep this information confidential and use it only for order fulfillment.
4.2 Riders
Your name, delivery address, and contact number are shared with the assigned rider to complete your delivery. Once delivery is completed, riders no longer have access to your information.
4.3 Service Providers
We work with trusted third-party service providers:
- Supabase — Database and authentication (data stored in Singapore, AP-Southeast-1)
- Sentry — Crash reporting and error monitoring
- Google Firebase — Push notifications (FCM)
- Google Maps — Address search and location services
These providers are bound by their own privacy policies and data processing agreements.
4.4 Legal Requirements
We may disclose your information if required by law, court order, or government authority under Philippine law.
5. Data Retention
We retain your personal information for as long as your account is active or as needed to provide our services. Order history is retained for a minimum of 3 years for legal and accounting compliance.
If you request account deletion, we will delete or anonymize your personal data within 30 days, except where retention is required by law.
6. Data Security
We implement appropriate technical and organizational measures to protect your personal information, including:
- All data transmitted between the App and our servers is encrypted via HTTPS/TLS
- Authentication tokens are stored in device secure storage (not plain local storage)
- Access to production data is restricted to authorized personnel only
- Regular security monitoring via Sentry and Supabase audit logs
No system is 100% secure. In the event of a data breach affecting your rights, we will notify you and the National Privacy Commission (NPC) as required by RA 10173.
7. Your Rights Under RA 10173
As a data subject under the Data Privacy Act of 2012, you have the right to:
- Be informed — Know what data we collect and how it is used
- Access — Request a copy of your personal data we hold
- Correct — Request correction of inaccurate or incomplete data
- Erase — Request deletion of your personal data ("right to be forgotten")
- Object — Object to the processing of your data in certain circumstances
- Data portability — Receive your data in a structured, electronic format
- Complain — Lodge a complaint with the National Privacy Commission (privacy.gov.ph)

8. Location Data
BrgyMart requests access to your device's location to:
- Automatically detect your delivery area
- Show nearby stores and accurate delivery estimates
- Enable riders to navigate to your location
You may deny location permission at any time through your device settings. Denying location access will require you to manually enter your delivery address.
9. Push Notifications
We send push notifications to update you on order status (confirmed, preparing, on the way, delivered). You may disable notifications at any time in your device settings or within the App under Settings → Notifications.
9.1 Seller App Bluetooth & Receipt Printing
The BrgyMart Seller app may request Bluetooth-related access to help merchants scan for compatible receipt printers, connect to a paired printer, and save printer preferences such as receipt style and device selection. This information is used only to support seller operations inside the app and is not used for advertising.
10. Children's Privacy
BrgyMart is not intended for users under 18 years of age. We do not knowingly collect personal information from minors. If we discover that we have inadvertently collected data from a minor, we will delete it promptly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this page and, where appropriate, notify you through the App. We encourage you to review this policy periodically.
12. Platform Monitoring & Safety
BrgyMart operates a platform monitoring system to ensure the safety, integrity, and reliability of our service. As the platform operator and Personal Information Controller, we reserve the right to review in-app communications between users (customers, riders, and sellers) under the following conditions:
- Dispute resolution — When a formal dispute or complaint is filed by any party, authorized BrgyMart personnel may access the relevant conversation to investigate and resolve the issue
- Safety and fraud prevention — Conversations may be reviewed when suspicious activity, harassment, abuse, or attempted fraud is reported or detected
- Legal compliance — Conversations may be reviewed when required by law, court order, or government authority under Philippine law
- Platform integrity — To detect and prevent misuse of the platform, including off-platform transaction solicitation, price manipulation, or policy violations
All monitoring access is performed by authorized BrgyMart administrators only, is logged with timestamps for accountability, and is strictly limited to the purposes stated above. Conversation data is never shared with third parties for commercial purposes.
By using BrgyMart, you acknowledge and consent to this monitoring as described in these Terms and this Privacy Policy, consistent with the Data Privacy Act of 2012 (RA 10173).
